No charges have been filed against an off-duty firefighter whose sports utility vehicle was involved in a deadly crash in Brooklyn on Sunday, as sources say investigators could not prove the fireman was behind the wheel.

The crash was captured in this grainy surveillance video obtained by NY1. In the video, seen above, a dark SUV is seen hitting the victim, who was wearing a white shirt.

The SUV sped off from the scene at 65th Street and 20th Avenue in Bensonhurst just after midnight Sunday.

The 25-year-old man who was hit was pronounced dead at Lutheran Hospital.

About four hours later, sources say the registered owner of the SUV, Pat Quagliariello, went to the 62nd Police Precinct, admitting his car was involved.

Sources say he was released because investigators could not confirm he was the driver.

According to published reports, Quagliariello's brother is a New York City police detective.
