A truck driver has been charged with causing a deadly pileup on the New Jersey Turnpike that critically injured actor Tracy Morgan.
Kevin Roper, 35, faces one count of death by auto and four counts of assault by auto.
Police say Roper failed to slow down for traffic ahead of him and swerved at the last minute to avoid an accident.
The Walmart Tractor trailer he was driving wound up rear-ending Morgan's limousine, causing a chain reaction that also involved another tractor trailer and three passenger vehicles.
Another comedian, James McNair who performed under the name Jimmy Mack, was killed.
Morgan, 45, and passenger Jeffrey Millea were flown to the hospital in critical condition.
A fourth passenger, comedian Ardie Fuqua Jr., was also listed in critical condition
The former Saturday Night Live and 30 Rock star was coming back from a performance at a casino in Delaware Friday night.
Morgan was born the Bronx and raised in Brooklyn.
